Article 41 of the Criminal Code states that you may defend yourself and others against an attack, provided that the force used is proportional and subsidiary. This means that the force used must be reasonable and that there was no less intrusive way to resolve the situation. Simply put: you may stop someone, but not go further than necessary to stop the threat.

  • 2. Call for help and contact the police โ€“ Make sure you quickly call 112 or ask someone else to do so. The police need to be informed as soon as possible.
  • 3. Act proportionally โ€“ Try to keep the suspect under control without using excessive force. A hold, blocking an escape route, or containing the suspect may be sufficient.
  • 4. Be aware of the legal consequences โ€“ Although the law allows you to intervene, legal complications can always arise. Stay within the limits of necessary force.
  • 5. Let the police take over – As soon as the police arrive, hand over the situation to them and provide a clear statement of what happened.

What this tourist did deserves respect. It’s easy to say from the sidelines or in hindsight what someone should have done, but in the moment itself, it takes tremendous mental strength to actually take action.
